Location-Based Services Terms
Article 1(Purpose)
The purpose herein is to prescribe the rights, obligations, and responsibilities between Onesoftdigm Corporation (the "Company") and its Members, and other necessary matters regarding the use of location-based services included in the health management solution Fitrus and its related services (the "Service") provided by the Company.
Article 2(Effectiveness and Change of Terms)
- These terms shall take effect when a customer who has applied for the Service or a personal location information subject agrees to these terms and registers as a user of the Service in accordance with the prescribed procedures set by the Company.
- If a Member clicks the Agree button for these terms online, they are deemed to have read and fully understood the contents of these terms and agreed to their application.
- The Company may amend these terms within a scope that does not violate relevant laws such as the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and the Act on the Regulation of Terms and Conditions.
- If there is an addition, deletion, or modification of the contents of these terms, the Company will provide notification through in-app announcements, the website, or the Member's email address at least 7 days prior to the amendment. However, if there are significant changes to the Member's rights or obligations, notification will be made at least 30 days in advance.
- If a Member does not explicitly express refusal to the application of the amended terms while the Company announces the amended terms in accordance with the preceding paragraph, the Member shall be deemed to have agreed to the amended terms.
Article 3(Application of Relevant Laws)
Matters not prescribed in these terms shall be governed by relevant laws such as the Act on the Protection and Use of Location Information, the Personal Information Protection Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, as well as the Company's Service Terms of Service and Privacy Policy.
Article 4(Content of Service)
The location-based services provided by the Company are as follows.

| Service Details | The Company requires location permissions to increase the accuracy of device searching when integrating the app with Fitrus devices (hardware such as the Fitrus Watch manufactured, sold, or officially approved for integration by the Company). However, geographical location information (GPS coordinates, etc.) accessible through these permissions is never collected or transmitted to the Company's servers and is only used temporarily for the purpose of connecting devices. |
Article 5(Service Usage Fees)
- In principle, the Company's Service is provided free of charge.
- Notwithstanding the preceding paragraph, data communication charges incurred when using wireless services are separate and shall be subject to the policies of each telecommunications carrier to which the Member has subscribed.
Article 6(Use or Provision of Personal Location Information)
The Company does not store real-time GPS coordinates on its servers. However, in accordance with the Act on the Protection and Use of Location Information, the Company automatically records and preserves records confirming the use and provision of location information, and such records are retained for one year before being destroyed without delay. The Company does not provide personal location information to third parties without the user's consent. If the Company provides personal location information to a third party designated by the Member, the Company immediately notifies the Member of the recipient, date/time, and purpose of the provision through the communication terminal device from which the personal location information was collected.
Article 7(Rights of Personal Location Information Subjects)
- A Member may withdraw all or part of their consent for the use and provision of personal location information at any time.
- A Member may request the temporary suspension of the collection, use, or provision of personal location information at any time.
- A Member may request access to, notification of, or correction of errors in the confirmation data regarding the use and provision of location information.
Article 8(Designation of Location Information Manager)
The Company designates a Location Information Manager to properly manage and protect location information and smoothly process user complaints.
Article 9(Exemption from Liability)
- The Company shall not be held liable for damages incurred by the Member if it cannot provide the Service due to the following reasons:
- In case of force majeure such as natural disasters or equivalent states.
- In case of intentional interference with the Service by a third party.
- In case of obstacles to service use due to reasons attributable to the Member.
- In case of other reasons where there is no intentional misconduct or negligence on the part of the Company.
- The Company does not guarantee the reliability or accuracy of the Service or information, materials, or facts posted on the Service and shall not be held liable for damages incurred by the Member as a result.
- The Company shall not be held liable for the loss of expected profits from using the Service or for damages incurred by the Member due to materials obtained through other services.
Article 10(Mediation of Disputes)
If a Member suffers damage due to an act of the Company violating the Location Information Act, the Member may claim damages.
If consultation regarding disputes related to location information is difficult, a Member may apply for a ruling to the Korea Communications Commission (KCC) or apply for mediation to the Personal Information Dispute Mediation Committee.
